Whenever the weight topic comes up the concern always seems to be regarding property damage. This article illustrates the fact that there can be other liability concerns and risks.

I’ve also reread the op and noted that the truck was described as a chassis cab with a flatbed. If the flatbed was added to the chassis cab truck the weight of the flatbed would become part of the payload. I’m also wondering why the GVWR for a F350 isn’t higher.

It should be noted that these examples are all commercial vehicles in commercial service, not private parties, and that only some of the issues could be due to exceeding tow rating, others were due to poorly maintained equipment and other factors.   It is also unclear who was sued, the operator, company or insurer.

I have no doubt the predatory lawyers out there would go after an overweight caused accident by a private party.

 

We can hardly watch the evening news anymore with all the lawyer ads- all touting the huge judgements they've won....
