Best way to make 5 into 4 scissors steps - need 36", not 40"+

I got a set of aluminum diamond plate scissor steps I want to mount to my tailgate in the down position.  E-trailer has a bracket - https://www.etrailer...rophy/TSSB.html - that I'll use. 

 

The 5 step version fits a tailgate height of 40" to 48".  My tailgate rests at about 36".  So I need to get rid of a step. 

 

It looks like I can cut off the aluminum frame parts (four cuts) so the bottom step rests on the ground, rather than the frame.

Has anyone tried this, and if so, how did it work?

I haven't done that but many of the step manufacturers let you add a step so I'm assuming taking one off is fine.
